Separation and Divorce

When parties to a marriage are satisfied that the relationship has irretrievably broken down, an application for divorce can be made twelve (12) months after separation. There are some allowances for attempted reconciliation during that twelve-month period and if a marriage has lasted less than two years, counseling is mandatory.

It is critical to note that divorce is a separate process to parenting issues and property settlement. Time limits also apply. It is important that you consult a Family Law Solicitor or Lawyer to discuss all your separation and divorce issues.

Children Lawyers

Where a child will live and how much time they spend with each parent (formerly referred to as "custody", "access", "residence" or "contact") are critical consequences of any separation or divorce. The best interests of the child(ren) are of paramount importance in determining the most appropriate parenting orders to put in place. Recently, the legal presumption has shifted to equal and shared parental responsibility for children. It is important to consult a duly qualified Solicitor or Lawyer in the field to ensure your parenting rights and the child(ren)'s welfare are preserved.

Property Disputes

Property and financial settlements are often quite complex and intricate matters which require specialised legal skill and experience. As Solicitors and Lawyers with experience in the field, we are able to resolve your property dispute with an emphasis on conciliation and early settlement.

Property settlement and financial matters can often fall outside the boundaries of a simple division of the former matrimonial assets. The work can also involve preparing a Binding Financial Agreement or Termination Agreement, Estate Planning, creating a Caveatable Interest, Powers of Attorney and Injunctive Relief to prevent the wrongful disposal of assets by a party.
